The Dickies American Worker of
the Year Contest ("Contest")
2010 OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. THIS CONTEST IS INTENDED FOR THE UNITED STATES AND WILL BE GOVERNED BY UNITED STATES LAW. DO NOT ENTER IF YOU ARE NOT LOCATED IN THE UNITED STATES AT THE TIME OF ENTRY. VOID WHERE PROHIBITED.

  1. ELIGIBILITY REQUIREMENTS: Both nominators and nominees must be legal residents of the 50 United States and the District of Columbia who are 18 years of age or older and of legal age of majority under the laws of their state. Employees, directors and officers of Williamson-Dickie Mfg. Co. ("Sponsor"), Sears Holdings Management Corporation, and each of their respective parent, subsidiary and affiliated companies, distributors, and web design, advertising, fulfillment, and judging/contest agencies involved in the administration, development, fulfillment and execution of this Contest (collectively, "Contest Parties"), and the immediate family members (spouse, parent, child, sibling, grandparent, and spouse or "step" of each) and those living in the same households of each such individuals (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Contest) are not eligible to participate.
  2. CONTEST ENTRY PERIOD: Contest begins on May 30, 2010 at 12:00:01 am Central Time ("CT") and ends July 15, 2010 at 11:59:59 pm CT (the "Contest Period"). The Web Site server is the official clock for this Contest.
  3. TO NOMINATE SOMEONE: Go online to www.WorkerOfTheYear.com (the "Web Site"), during the Contest Period and follow the on-screen directions to nominate someone who you believe deserves to be recognized as The Dickies American Worker of the Year. You may nominate yourself or someone you know personally. You will be asked to answer a few questions about yourself and the nominee and to write an essay answering the following questions: 1) What does hard work mean to you/the nominee; and 2) Give us an example of how you/the nominee exemplifies the American Worker. ("Essays"). Your Essays must be in English and may not exceed 500 words per Essay. Once your registration is complete click the "Submit" button and you will receive confirmation that your Contest entry has been received. Limit one (1) entry per person throughout the Contest Period.

    Essays must be truthful and Sponsor reserves the right to verify information contained in the Essays. Essays must be the original work of the entrant; may not have won previous awards; may not have been used publicly previously by any third party; must not infringe any third-party’s rights; must be suitable for publication (i.e., may not be obscene or indecent); must not contain obscene or pornographic material; may not contain defamatory statements; may not invade privacy, publicity or other rights of any person, firm or entity; may not in any other way violate applicable laws and regulations; may not contain any reference to any third party trademarks, names (other than the name of the nominee’s employer) or third party logos; and may not contain any copyrighted works owned by third parties. All Entries will be reviewed for content eligibility and compliance with these Official Rules before being judged. Entries containing false information, prohibited material or inappropriate content, as determined by the Sponsor, in its sole discretion, may be disqualified. Sponsor makes the final determination as to what Entries are eligible to take part in this Contest. Submission of an Entry grants Sponsor and its agents the unconditional, irrevocable, worldwide right to publish, use, adapt, edit and/or modify such Entry in any way, in any and all media, without limitation, and without consideration to the entrant, whether or not such Entry is selected as a winning Entry. BY SUBMITTING THE ORIGINAL ENTRY, THE ENTRANT REPRESENTS AND WARRANTS THAT HE/SHE HAS ALL RIGHT, TITLE AND INTEREST NECESSARY TO GRANT THE SPONSOR THE WORLDWIDE, IRREVOCABLE AND UNRESTRICTED RIGHT AND LICENSE TO ADAPT, PUBLISH, USE, EDIT, AND/OR MODIFY SUCH ENTRY IN ANY WAY AND POST THE ORIGINAL ENTRY ON THE INTERNET OR USE THE ORIGINAL ENTRY IN ANY OTHER WAY AND AGREES TO INDEMNIFY AND HOLD SPONSOR HARMLESS FROM ANY CLAIMS TO THE CONTRARY.
  4. SELECTION OF REGIONAL FINALISTS: All eligible Entries will be judged by a panel of judges ("Judges") on or about July 26, 2010 to select six (6) nominees as regional finalists, based on the following judging criteria:
    • How well the Nominee represents the value of Honesty - maximum of 25 points
    • How well the Nominee represents the value of Hard Work - maximum of 25 points
    • How Well the Nominee represents the American Worker - maximum of 50 points
    Nominees will be assigned to a region based on the state of residence provided by the nominator. A nominee is only eligible to be a regional finalist in one (1) region. The regions are:

    Region 1
    Connecticut; Delaware; Maine; Massachusetts; New Hampshire; New Jersey; New York; Rhode Island; Vermont; and Washington D.C.

    Region 2
    Illinois; Indiana; Kentucky; Maryland; Michigan; Ohio; Pennsylvania; and West Virginia

    Region 3
    Alabama; Florida; Georgia; Louisiana; Mississippi; North Carolina; South Carolina; Tennessee; and Virginia

    Region 4
    Iowa; Kansas; Minnesota; Missouri; Nebraska; North Dakota; South Dakota; and Wisconsin

    Region 5
    Alaska; Hawaii; Idaho; Montana; Oregon; Washington; and Wyoming

    Region 6
    Arizona; Arkansas; California; Colorado; Nevada; Oklahoma; Texas; New Mexico; and Utah

    SELECTION OF GRAND PRIZE WINNER: The six (6) nominees selected as regional finalists will be contacted by Sponsor on or about August 9, 2010 and asked to participate in phone interviews regarding their experiences and the experience described in the Essays submitted by the nominators. The interviews will be conducted by the Judges and will be recorded. Based on the personal interview, the Judges will then re-evaluate the regional finalists based on the following judging criteria to select the Grand Prize winner:
    • How well the Nominee represents the value of Honesty - maximum of 15 points
    • How well the Nominee represents the value of Hard Work - maximum of 15 points
    • How well the Nominee represents the value of Representation of the American Worker - maximum of 30 points
    • Personality and Character (based on Interview) - maximum of 40 points
    Grand Prize winner will be announced on or about September 6, 2010 by the Sponsor.

    For Both Judging Rounds: In the event of a tie, the tie breaker will be based on the highest score in the first Judging Criteria, continuing thereafter to each Judging Criteria in order, as needed to break the tie. All submitted Entries and Entrants in this Contest shall be governed by these Official Rules and the decisions of the Judges and Sponsor. Entrants agree that the Sponsor and Judges have the sole right to decide all matters and disputes arising from this Contest and that all decisions of Sponsor and Judges are final and binding.
  5. PRIZES AND APPROXIMATE RETAIL VALUES ("ARV"):

    ONE (1) GRAND PRIZE: a check payable to the winner in the amount of $100,000.

    SIX (6) REGIONAL FINALIST PRIZES: a check payable to the regional finalist in the amount of $5,000.

    Prizes will be awarded to the selected nominees only; the nominator is not eligible to win a prize (unless the nominator nominated himself or herself).
  6. GENERAL CONDITIONS: Potential regional finalists are subject to verification, including verification of age. If a potential regional finalist is found not to be eligible or not in compliance with these Official Rules, or if contest notification or any prize is returned as undeliverable, the potential Finalist will be disqualified. Sponsor’s decisions shall be final and binding on all matters relating to the Contest. Finalists are solely responsible for any taxes on their respective prizes, and winners who receive a prize valued at $600 or more will be issued an IRS Form 1099 for the value of the prize. No cash equivalent or substitution of prize is offered, except at the sole discretion of the Sponsor. No transfer of prize is allowed. By participating, entrants agree to these Official Rules, the Web Site Terms of Use, and Sponsor’s Privacy Policy (available at www.WorkerOfTheYear.com), which are final and binding in all respects. Unclaimed prizes will not be awarded. Potential regional finalists will be contacted by mail and will be required to complete, sign, and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release (granting the use of their name, city/state, likeness, or photography by Sponsor and the Contest Parties for advertising/publicity purposes, without further compensation) within seven (7) days of attempted notification of potential regional finalist status. If seven (7) days passes without response, or if potential regional finalist is disqualified, prize will be forfeited and an alternate finalist will be selected. Sponsor reserves the right to require a confidential background check upon potential regional finalist selection to confirm eligibility as outlined herein and to help ensure that the use of any such person in advertising or publicity for the Contest will not bring Sponsor or Contest Parties into public disrepute, contempt, scandal, or ridicule or reflect unfavorably on the Contest or Sponsor as determined by Sponsor in its sole discretion. If, in the Sponsor's sole opinion, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right to cancel, modify or terminate the Contest and select the potential regional finalist(s) and/or winner from all eligible entries received prior to such event. Sponsor reserves the right to disqualify any individual who tampers with the entry process or the Web Site or acts in a disruptive manner. This Contest is offered only in the United States and is governed by the laws of the state of Texas, and entrant consents to jurisdiction and venue in, and agrees that all claims and dispute must be resolved in, the federal or state courts in Tarrant County, Texas.
  7. LIMITATIONS OF LIABILITY AND RELEASE: By acceptance of prize, regional finalist agrees to release Sponsor and Contest Parties from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses of any kind to person or property resulting in whole or in part, directly or indirectly, from participation in the Contest; from acceptance, possession, misuse or use of any prize; from participation in any prize-related activity or any travel related thereto which may be sustained in connection with the receipt, ownership or use of the prize, or any typographical or other error in the Official Rules or the offering and announcement of prizes. Contest Parties assume no responsibility for lost, late, misdirected, stolen, illegible, inaccurate, damaged or incomplete entries or submissions, failure or unavailability of electronic equipment, communications or internet connections, or other errors, failures or malfunctions of any kind. By accepting a prize, a regional finalist grants permission for Sponsor and Contest Parties and those acting under their authority to use his/her name, photograph, voice and/or likeness, for advertising and/or publicity purposes, in any and all media now known or hereinafter invented without territorial or time limitations and without additional compensation.
